Terms of Service

These Terms of Service ("Terms") govern your use of streamoverlay.app (the "service"). By signing in or using the service, you agree to these Terms.

1. The service

streamoverlay.app provides a platform for Twitch (and in future, other streaming platforms) streamers to run overlays, a chatbot, loyalty + redemption systems, tipping, a control deck, and a designs gallery — all rendered as browser sources in OBS or similar broadcasting software.

2. Eligibility

You must be 13 years old or older to use the service. By using it you represent that you meet this requirement and that you have the right to authorize the streaming-platform scopes you grant us.

By publishing a public design through the gallery you grant other users of the service a non-exclusive licence to install and use that design on their own channels. You can revoke this by removing or unlisting the design — already-installed instances continue working at the version they were installed at.

You agree not to use the service to:

Custom designs (HTML/CSS/JS authored by users) execute in viewers' browsers. You're responsible for what your designs do. Authoring designs that exfiltrate data, mine cryptocurrency, run automated abuse, or otherwise harm viewers will result in immediate account termination.

6. Tipping

Tipping is processed by Stripe Connect. We charge 0% platform fee. Stripe's standard processing fees (currently 2.9% + 30¢) apply and are paid by the streamer. By accepting tips you agree to Stripe's Connected Account Agreement and applicable tax obligations in your jurisdiction.

7. No warranty

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, non-infringement, or merchantability. We do not guarantee that the service will be uninterrupted, error-free, secure, or available at any specific time.

8. Limitation of liability

To the maximum extent permitted by law, streamoverlay.app, its operators, and contributors are not liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost revenue, lost tips, lost viewership, interrupted broadcasts, missed alerts, lost loyalty data, or business interruption — arising from your use of the service.

Our total aggregate liability for any claim arising from these Terms or the service is limited to the amount you paid us in the preceding 12 months, which for free users is zero.

9. Third-party services

The service integrates with Twitch, Stripe, Giphy, Cloudflare, and other third parties. We are not responsible for outages, policy changes, or data handling on those platforms. Their respective terms govern your relationship with them.

10. Termination

You may stop using the service at any time by logging out. We may suspend or terminate accounts that violate these Terms or pose risk to the service or other users.

11. Changes to these terms

We may update these Terms. Material changes will be announced on the platform and via our Discord. Continued use after changes constitutes acceptance.

12. Governing law

These Terms are governed by applicable consumer-protection law in your jurisdiction. Disputes will first be addressed informally — please reach out via Discord before pursuing other remedies.

13. Severability

If any provision of these Terms is found unenforceable, the rest remain in effect.
